Terms of Use

This agreement is between you and Jiang Dewu, an individual developer (“we”, “us”). By downloading, installing, or using Clipsmith (the “App”), you agree to it. If you do not agree, do not use the App.

1. What this is

A video toolbox that trims, compresses, converts, and extracts audio and subtitles from videos you already have on your iPhone. All processing happens on your device; nothing is sent to us. See the Privacy Policy for the detail.

2. Scope of licence

We grant you a limited, non-exclusive, non-transferable licence to use the App for your own personal or professional video work.

Where you obtained the App from the Apple App Store, this licence is limited to use on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

You may not resell, rent, sub-licence, redistribute, decompile, or reverse engineer the App, except where the law expressly permits it.

3. Your videos and your rights to them

You keep all rights to the videos you process. We claim no ownership of them and never receive them.

You are responsible for making sure you have the right to use, edit, and share any video you process — including the rights of people who appear in it and of anyone who owns the music or other material in it. The App works only on files already on your device; it does not download videos from websites or social platforms, and you must not use it to infringe anyone's copyright or other rights.

4. Subtitles are machine-generated

Subtitles are produced by your device's speech recognition. They may contain errors — wrong words, missing words, or imprecise timing — especially with background noise, music, accents, or overlapping speech. Review subtitles before you publish them. We are not responsible for the content of subtitles you publish.

5. Subscriptions, free trial, and payment

The App can be used for free with limits. Additional features are available through an auto-renewing subscription purchased in the App through the Apple App Store. The following applies:

• Payment is charged to your Apple Account at confirmation of purchase.
• An auto-renewing subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
• Where a free trial is offered, it converts automatically into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. A free trial is available once per Apple Account for this subscription group.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• You can manage your subscription and turn off auto-renew in your Apple Account settings after purchase.
• The title, duration, and price of each plan, and the length of any free trial, are shown in the App before purchase and on the App Store product page.

All charges, renewals, refunds, and invoices are handled by Apple under its own terms. The App never receives or stores payment details.

6. Your files can be lost

Because there is no server, there is no backup and no recovery. Files kept inside the App are deleted if you delete them, delete the App, or restore your device without a backup that includes app data. Save anything you want to keep to Photos or to the Files app.

7. No warranty

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted or error-free, that every video format will be supported, or that output quality or file size will meet your expectations.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, footage, files, revenue, or opportunity, arising from your use of or inability to use the App. Where liability cannot be excluded, our total liability is limited to the amount you actually paid for the App in the twelve months before the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of sections 7 and 8 may not apply to you.

9. Legal compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-party terms

You must comply with any applicable third-party terms when using the App and when publishing content made with it — for example, the terms of the social platforms you post to.

11. Apple App Store terms

The following applies where you obtained the App through the Apple App Store.

11.1 Acknowledgement

You and we acknowledge that this agreement is concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for the App and its content. This agreement does not provide for usage rules for the App that conflict with the Apple Media Services Terms and Conditions.

11.2 Maintenance and support

We are solely responsible for providing any maintenance and support services for the App, as specified in this agreement or as required under applicable law. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

11.3 Warranty

We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

11.4 Product claims

We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

11.5 Intellectual property rights

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.

11.6 Third-party beneficiary

You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this agreement, and that upon your acceptance of its terms and conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary of it.

12. Changes

These terms may be revised. The current version always lives at this address with its effective date at the top. Continuing to use the App after a change means you accept the revised terms.

13. Governing law

These terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-laws rules, except that this does not deprive you of the protection of any mandatory consumer law of your country of residence.
